1. Services Overview

QuantumSpider provides the following services:

All services are provided on an as-is basis. QuantumSpider reserves the right to modify, suspend, or discontinue any service at any time with notice where reasonably practical.

2. Acceptance of Terms

By accessing QuantumSpider's website, services, or creating an account, you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you may not use our services. QuantumSpider may update these terms at any time. Continued use of our services following such updates constitutes acceptance of the new terms.

You must be at least 18 years of age and a legal resident of the jurisdiction where you reside to use our services. You are responsible for all activity that occurs under your account.

3. Payment Terms

Billing Cycle

All accounts operate on a pre-payment basis. Your billing cycle corresponds to your chosen subscription term (monthly, annual, etc.). Renewal reminders are sent via email three (3) days before your renewal date.

Automatic Renewal

Your account will automatically renew at the end of your billing cycle unless you cancel before the renewal date. You can manage renewals through your client account dashboard or by contacting support.

Payment Methods

We accept major credit cards and other payment methods as displayed during checkout. Payment details are processed securely. QuantumSpider does not store full credit card information.

Late Payments

If payment is not received within 7 days of the due date, a $5.00 late fee will be applied to your account. If payment remains unpaid for 30 days, your account is subject to suspension. Accounts not brought current within 60 days may be terminated permanently.

Price Changes

QuantumSpider reserves the right to change prices at any time. Existing customers will receive notice via email at least 30 days before any price increase takes effect on their next renewal. Promotional pricing is subject to the terms of the specific promotion.

4. Refunds & Money-Back Guarantee

QuantumSpider offers a 30-day money-back guarantee on most new purchases, excluding promotional packages and domain registrations. To qualify:

Important: Annual plans are non-refundable after the 30-day guarantee period. Monthly plans are non-refundable once the initial month is completed. Domain registrations and promotional packages are never refundable. Accounts terminated for violation of our Acceptable Use Policy receive no refund.

5. Acceptable Use Policy

You agree not to use QuantumSpider services for any unlawful purpose or in violation of any laws or regulations. Prohibited activities include, but are not limited to:

Resource Abuse

Shared hosting accounts operate on shared infrastructure. You agree not to:

If your account consumes excessive resources, you will be notified and given 48 hours to remedy the situation. Failure to comply may result in account suspension or termination, or upgrade requirements.

Bandwidth Usage

Bandwidth is intended for website content delivery, not as offsite storage. Downloads, backups, and large file transfers should comply with your plan limits. Exceeding bandwidth limits may result in additional charges or account restrictions.

Enforcement

QuantumSpider reserves the right to investigate suspected violations and may take immediate action without prior notice if illegal content or extreme abuse is detected. QuantumSpider will cooperate fully with law enforcement investigations.

6. Uptime & Service Level Agreements

99.99% Uptime Guarantee (Shared Hosting)

QuantumSpider guarantees 99.99% availability for shared hosting accounts in good standing. This means your website should be accessible to the public 99.99% of the time each month.

SLA Details

KVM VPS & Gateway API

KVM VPS and Gateway API services operate under standard industry SLAs. Specific SLA terms for these services are detailed in your service agreement or available upon request.

7. Security & Network

Compromised Accounts

If your account is compromised, notify QuantumSpider immediately. QuantumSpider may suspend service if malicious activity is detected. You remain responsible for all charges and actions under your account during any compromise.

8. Suspension & Termination

QuantumSpider May Suspend or Terminate Services:

Termination for Violations

Accounts terminated for violation of these terms receive no refund. QuantumSpider will attempt to notify you before suspension whenever reasonably practical, but reserves the right to act immediately for severe violations.

Customer-Initiated Termination

You may terminate services at any time. Termination is effective immediately upon request. Refunds are subject to Section 4 above. You are responsible for all charges through the termination date.

Data Removal

After termination, QuantumSpider may delete your account data after a reasonable retention period (typically 7-30 days). You are responsible for backing up all critical data before termination.

9. Disclaimers & Limitation of Liability

Disclaimer of Warranties

QuantumSpider services are provided "AS IS" without warranties of any kind. QuantumSpider does not warrant that services will be:

Important: QuantumSpider is not responsible for data loss, unauthorized access, or service interruptions. You are responsible for maintaining backups of all critical data. Regular backups are strongly recommended.

Limitation of Liability

To the maximum extent permitted by law, QuantumSpider's total liability for any claim arising from these terms shall not exceed the amount you paid for services in the three (3) months preceding the claim. QuantumSpider is not liable for:

Domain Registration

All domain registration fees are non-refundable, in whole or in part, regardless of when you transfer, suspend, or cancel the domain. You are responsible for timely renewal to prevent expiration and loss of the domain name.

Domain Ownership

You represent that you own or have legal right to use any domain name registered. QuantumSpider may investigate ownership disputes and may suspend the domain pending resolution. ICANN and domain registrars have authority over domain disputes.

11. Gateway API & POKT Network

Service Nature

QuantumSpider's Gateway API provides decentralized RPC (Remote Procedure Call) infrastructure powered by the POKT Network. This service allows applications to query blockchain data through a distributed network of independent node operators.

Blockchain Considerations

POKT Network Integration

QuantumSpider operates nodes on POKT Network. Service availability depends on both QuantumSpider infrastructure and POKT Network health. Network-wide disruptions are not QuantumSpider's responsibility. You assume all risk associated with decentralized infrastructure.

Data Availability

QuantumSpider makes no guarantees regarding blockchain data completeness or accuracy. You are responsible for validating data. Blockchain state changes may not be immediately reflected due to network propagation delays.

12. Intellectual Property

Your Content

You retain all rights to content you create and host on QuantumSpider services. By hosting content with QuantumSpider, you grant QuantumSpider a license to:

QuantumSpider Property

All QuantumSpider logos, trademarks, designs, and materials are protected. You may not use QuantumSpider's intellectual property without written permission.

Third-Party IP

You represent and warrant that all content you host does not infringe on any third-party intellectual property rights. You indemnify QuantumSpider against all claims arising from your content.

13. Privacy & Data Protection

QuantumSpider's Privacy Policy governs the collection and use of personal information. By using our services, you consent to our privacy practices.

Data Protection

QuantumSpider maintains reasonable security measures to protect customer data. However, no online service is completely secure. You are responsible for protecting your account credentials and sensitive information.

GDPR & CCPA Compliance

QuantumSpider complies with applicable data protection regulations including GDPR (EU) and CCPA (California). If you have data protection questions, contact our privacy team.

Law Enforcement Requests

QuantumSpider may disclose account information to law enforcement when presented with valid legal process (subpoena, warrant, court order). QuantumSpider will provide notice to customers when legally permitted to do so.

14. General Provisions

Governing Law

These Terms of Service are governed by the laws of the United States of America. Any disputes shall be subject to the jurisdiction of courts in the United States.

Entire Agreement

These Terms of Service, together with your service agreement and any additional policies, constitute the entire agreement between you and QuantumSpider. No other communications, promises, or representations are binding unless in writing and signed by an authorized QuantumSpider representative.

Amendments

QuantumSpider may amend these terms at any time by posting updated terms on this page. Amendments become effective 30 days after posting for existing customers, or immediately for new customers. Continued use of services constitutes acceptance of amended terms.

Severability

If any provision of these terms is found to be unenforceable, that provision is severed and the remaining terms continue in effect.

Waiver

QuantumSpider's failure to enforce any provision does not constitute a waiver of that provision.

Assignment

You may not assign these terms without QuantumSpider's written consent. QuantumSpider may assign these terms in whole or in part.
